Website owner, the offering, and binding of Terms
This website is owned and operated by Fiat Lux International, LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information about and the ability to purchase the following services: certified ThetaHealing® workshops, personal development workshops, healing and personal development programs for individuals, group coaching programs, online self study courses, and audio meditations. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
Who can use this website and what are the requirements to create an account
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Key commercial Terms offered to customers
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it:
(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
We reserve the right to change our prices for services and products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
We have the right to refuse service to anyone at any time without an explanation.
In the event of purchasing and engaging in a personal program, session, group coaching or a workshop, any service provider may ask any person to exit or terminate their agreement without an explanation due to any behavior that lowers the quality of the workshop, program, session, group coaching, workshop or experience for the service provider or any other participants engaged without issuing a refund. Examples of behavior includes being a nuisance, harassment of any kind, hostility, making inappropriate comments, creating distractions that need to be addressed which takes the focus away from teaching or the service being offered, any form of harmful conduct.
Policy for seminars, workshops and private programs (3,6,12 months)
Workshops/Seminars:
We reserve the right to cancel a workshop at any time. If we cancel a workshop, you will receive a full refund of seminar fees. If we reschedule or postpone a workshop, your payment will be transferred to the new scheduled dates.
Deposits/Registration Fees: All deposits/registration fees are non-refundable, however, they are transferrable to another seminar with us.
Refunds are available only for the ThetaHealing® Intuitive Anatomy Workshop paid in full (less a deposit/registration fee) up to five days before your seminar begins.
No refunds are available on all other ThetaHealing workshops. In the case of a documented sickness (Doctor's note) or covid positive diagnosis, a credit toward a future seminar is available if you give notice between four and one day(s) before your workshop begins. Credit may be applied to any program for one year following date of cancellation. There is no guarantee that a workshop will be offered within one year of the customer's cancellation date.
No credit or refund is available if you cancel on the arrival day or start date unless you are covid positive and have supporting documentation; if you do not show up; if you are sick; or if you leave an event early for any reason. No refund will be available if you attend a seminar or purchase a program and are dissatisfied with its presentation, content or personal results.

Partial scholarships may be offered on selected workshops. If you receive a scholarship, you agree to keep all information confidential.
Payment Plans: We may offer the option of payment plans for some of our seminars. Payment plans operate in the following ways: (i) fully complete before the start of the program or (ii) Payment begins at the moment of sign up and runs throughout duration of workshop or a specified duration of time. If a payment plan is unpaid, we reserve the right to remove or hold the enrollment or service until the balance is paid in full.
Private Programs:

For private programs where you agree to work on a one on one basis with Tanya Gabriele (the for the period of 3, 6, or 12 months, you agree to:

Be collaborative, open and respectful to the service provider you are engaged with and to the work.

Take responsibility to implement the changes needed in your life to the best of your ability.

Be committed to the program and your results investing and respecting the time, energy and investment it takes.

To show up on time to your designated appointments. If you are more than 5 minutes late, your appointment will be cancelled.

Scheduling:

A time for a standing session appointment will be agreed upon based on the weekly or bi-monthly (every other week) cadence of program agreed upon. You will not be allowed to makeup or reschedule any missed sessions or extend the end date of the program.

Your program has a start date and an end date that adheres to the agreed upon weekly or bi-monthly cadence based on the number of sessions agreed upon. If you miss a session, you will not be allowed to rescheduled beyond the end date of your session, nor during any other period of time throughout the duration of your program time. You will not be allowed to makeup or reschedule any missed sessions. You will not be refunded for any missed sessions in any way.

If you need to reschedule your session time, please do so 24-48 hours in advance. Sessions are not guaranteed to be rescheduled. Sessions will be rescheduled if service provider has schedule availability to accommodate. If service provider is unable to accommodate based on service provider's schedule, you will loose your session and you will not have the opportunity to make it up.

Sessions are 60 minutes. They may run over time to a maximum of 90 minutes.
All sessions and the nature of what is discussed in sessions is confidential.

Private programs are not refundable.

Retention of right to change offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Ownership of intellectual property, copyrights and logos
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Tanya Gabriele. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
Indemnification
You agree to indemnify and hold Tanya Gabriele and Fiat Lux International LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website including any type of workshop, session or event.
By scheduling, paying and engaging in any type of service, event or workshop, you understand that Tanya Gabriele is not a medical doctor or mental health doctor trained to treat or diagnose illness, conditions, or make recommendations involving pharmaceutical drugs or handle medical emergencies.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Tanya Gabriele and Fiat Lux International LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the services.
To the maximum extent permitted by applicable law, Tanya Gabriele and Fiat Lux International LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to change and modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
Promotional emails and content
You agree to receive from time to time promotional messages and materials from us, by email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
Results and guarantee for Programs & ThetaHealing Workshops
All services offered by us are for educational and informational purposes only. We do not guarantee results by engaging in our services including ThetaHealing workshops, or make any health claims.
You understand that obtaining any personal results with this work or any stipulated ideas, results or strategies that may be stated or suggested on our website and platform are varied for each individual and are dependent on a number of factors for each person including: commitment, consistency, knowledge, skill level, dedication, relationships, financial situation and the condition of your health to name a few. You understand it is your responsibility to participate fully and practice to develop skill level in order to receive the maximum benefit, and that results differ from person to person. You understand we cannot guarantee any specific results in any area of your life for you or anyone else.
Any testimonials or examples used does not guarantee that you will achieve the same outcome.
You understand that the information on this website, platform, services offered including private sessions, ThetaHealing workshops, private programs, group coaching or any other service cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, medical, psychological, financial or legal affairs. You understand that Tanya Gabriele does not provide health, psychiatric, legal or financial advice. Any opinions given are not to be solely relied upon, and it is your responsibility to seek professional advice. By engaging in our services, you agree not to hold us liable for any decisions, actions, or results - at any time under any circumstance.
State of Health in preparation and during Programs & ThetaHealing Workshops
In order to receive the optimal benefit of any program or workshop, you must be in good health
This means:

You will not use any illegal drugs or alcohol for a minimum of 48 hours before any workshop. Anyone in violation of this term will be asked to leave and will not be refunded.

You will not engage in any form of substance abuse during the course of any program or workshop.

You will only take prescription medication as prescribed to you by your doctor, and will not stop taking it during the course of our program or seminar unless told so by your doctor or unless discussed with your doctor or psychiatrist

You will take care of yourself - eat proper meals, drink plenty of water, make time for adequate sleep.

If you have an existing medical condition, it is your responsibility to inform Tanya Gabriele before registering for a workshop or program to: (i) inform of a medical condition along with emergency contact and medications, and/or (ii) to see if attending is right for your health.
Business and self promotion
You understand the nature of the programs offered on this website are for healing and personal development, and that this is the reason you and other people are attending.
You understand that engaging in any services, programs or workshops is not a networking forum and you will not solicit people.
Self promotion of any kind is not permitted on any of Fiat Lux's platforms which includes, and is not limited to:

Workshops or any kind including ThetaHealing workshops, events, gatherings, off-sites, practice groups, group coaching, social media such as You Tube, Facebook, Facebook Groups, Instagram without the written permission of Tanya Gabriele.

You understand that this platform is not a place for you to solicit clients and market your services, and that this platform does not provide you with clients and is not meant to be used a networking forum.

Any violation of this agreement will result in the termination of your relationship with this platform and your removal from any workshop or event without a refund.

You understand that Tanya Gabriele is not responsible for connecting you with other students, individuals or clients across the platform or divulging their personal contact information to you. You understand that if you wish to exchange contact information with anyone you have had an interaction with any of the services offered on this platform, or engage in any type of relationship, that it is your own personal responsibility to connect with them.

You agree not to engage in any personal relationships with students while attending workshops
Force Majeure
In the event of an act of God, Tanya Gabriele/Fiat Lux is not liable to continue services scheduled. In such an event, Tanya Gabriele has the choice to either (i) postpone/reschedule the dates of any workshop, services or program without issuing a refund or (ii) choose to issue a refund and cancel any workshop, services or programs.
Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of California, USA, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in San Francisco. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
